These Terms of Use govern your access to and use of Memivio, a mobile application provided by AI-Construct LLC. By creating an account, accessing, or using Memivio, you agree to these Terms.
If you do not agree to these Terms, do not use the app.
2. Use of the App
Memivio is designed to help you save, organize, search, recall, and create reminders from personal memories, including photos, notes, locations, summaries, tags, and related information.
You are responsible for the content you save, upload, create, or process through Memivio.
You agree to use Memivio only for lawful purposes and in accordance with these Terms.
3. Privacy
Your use of Memivio is also governed by our Privacy Policy, which explains how we collect, use, store, process, and delete your information.
By using Memivio, you acknowledge that your information may be processed as described in the Privacy Policy.
4. Your Content
You retain ownership of the photos, notes, memories, locations, reminders, tasks, and other content you upload, save, or create in Memivio.
By using the app, you grant AI-Construct LLC a limited right to store, process, display, transmit, and use your content only as needed to operate, provide, secure, support, and improve Memivio.
You are responsible for ensuring that you have the right to upload or store any content you add to the app.
5. AI Features and Output
Memivio may use artificial intelligence features to generate summaries, tags, search results, reminders, tasks, suggestions, and answers based on the content you choose to save or search.
AI-generated output may be incomplete, inaccurate, outdated, or misleading. You should review important information before relying on it.
Memivio should not be used as your only source for critical medical, legal, financial, emergency, safety, or time-sensitive information.
6. Sensitive Information
You should use caution when saving sensitive personal information in Memivio.
Do not use Memivio as the only place you store critical information such as medical instructions, legal documents, financial records, emergency contacts, safety instructions, passwords, or information needed in urgent situations.
Memivio is intended to assist with personal organization and recall, not to replace professional advice, secure records management, emergency systems, or legal/financial decision-making.
7. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to use appropriate device security, such as a passcode, biometric authentication, or other protections, especially when storing private or sensitive memories.
Notify AI-Construct LLC if you believe your account has been accessed without authorization.
8. Private Memories
Memivio may offer features that allow certain memories to require device authentication before opening in the app.
Private memories are still stored using cloud services like other memories. Device authentication helps restrict access within the app, but it does not mean the memory is stored only on your device.
9. Subscriptions and Payments
Some Memivio features may require a paid subscription or one-time purchase.
Subscription pricing, billing frequency, renewal terms, cancellation options, and refund handling may be managed through the applicable app store or payment provider.
Subscriptions may renew automatically unless canceled before the renewal date. You are responsible for managing and canceling your subscription through the platform where you purchased it.
AI-Construct LLC may change pricing, features, or subscription plans over time. Any changes will apply according to the rules of the applicable app store or payment provider.
10. Acceptable Use
You agree not to use Memivio to:
- Store, upload, or process illegal content.
- Violate another person's privacy, intellectual property, or other rights.
- Attempt to access another user's account, data, or memories.
- Interfere with or disrupt the app, servers, security systems, or related services.
- Reverse engineer, copy, resell, or misuse the app.
- Upload harmful code, malware, or content intended to damage systems.
- Use the app for harassment, exploitation, abuse, fraud, or other harmful activity.
11. Account and Data Deletion
You may delete individual memories or request deletion of your account and associated app data through the app settings or available support contact.
Account deletion removes app data associated with your account and signs you out of Memivio.
Some limited information may be retained where required for legal, billing, security, fraud-prevention, backup, or operational purposes.
Deleted data may not be recoverable.
12. Suspension or Termination
AI-Construct LLC may suspend or terminate your access to Memivio if we believe you have violated these Terms, created risk for other users, misused the app, failed to pay required fees, or used the app in a way that may harm AI-Construct LLC, Memivio, or others.
You may stop using Memivio at any time.
13. App Availability and Changes
AI-Construct LLC may update, modify, suspend, or discontinue Memivio or any feature at any time.
We may release new features, change existing features, or remove features as the app evolves.
We do not guarantee that Memivio will always be available, uninterrupted, error-free, or compatible with every device or operating system.
14. No Professional Advice
Memivio may help organize and recall information, but it does not provide medical, legal, financial, mental health, emergency, or professional advice.
Any AI-generated summaries, suggestions, or reminders are for convenience only and should not replace professional judgment or advice from qualified professionals.
15. No Warranty
Memivio is provided "as is" and "as available."
To the fullest extent permitted by law, AI-Construct LLC makes no warranties or guarantees regarding the app, including that it will be accurate, secure, uninterrupted, error-free, or meet your expectations.
16. Limitation of Liability
To the fullest extent permitted by law, AI-Construct LLC is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of Memivio.
This includes, but is not limited to, loss of data, loss of memories, missed reminders, inaccurate AI output, service interruptions, unauthorized access, or reliance on information generated by the app.
17. Changes to These Terms
AI-Construct LLC may update these Terms from time to time.
If we make material changes, we may notify you through the app, app store listing, or other reasonable means.
Continued use of Memivio after updated Terms become effective means you accept the updated Terms.
